TERMS & CONDITIONS

These terms and conditions form the basis on which you can visit us and our website.  They contain important information so please familiarise yourself with these.  

This site is owned and operated by Be Planet Kind Ltd. If you have any questions or comments about these terms and conditions or our website please email rachel@beplanetkind.co.uk.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not distribute, modify or repost anything on this website for any purpose without prior approval. 

   

The contract  

Once your order is placed, we’ll send an email confirming we have received this. Payment for the entire order must be received before your order is accepted. Payment can be made by credit or debit card through Wix payments or via PayPal. Payment must be received before receipt of your order.  All prices are in GBP (Pounds Sterling) which is the only accepted currency. Payment of the price of goods represents an offer on your part to purchase the goods, which will be accepted by us when the goods are dispatched. Only at this point is a legally binding contract created between us.  We reserve the right to cancel the contract between us if any of the following occur:  

  • We have insufficient stock to deliver the Goods you have ordered;  

  • Delivery to your area is not possible by the delivery service provider 

  • We have reason to suspect that there is a risk of a fraudulent transaction. 

In the event of cancellation, we will notify you by email and will refund to the original payment method any sum deducted by us (in respect of Goods provided by us, and delivery services provided by the delivery service provider (unless they are to be refunded directly by the delivery service provider)), as soon as possible but within 30 days of your order.  

   

Confirmation of your order  

To process your order and send confirmation, you will need to provide us with your e-mail address. We will notify you by this method as soon as possible to confirm we have received your order and the details.  

If you notice a problem with the details you have supplied or the order, please contact us and we will try to help. Options will depend on how far along processing your order we are at that point but we will do our best.   


Delivery and timescales 


Please note I currently only ship to addresses in the UK. Standard delivery costs £3.40 by Royal Mail (estimated 3-5 working days for receipt). Standard delivery for orders over £55 is free and should take about 3-5 working days. 


If you need it faster, please choose an alternative at check out or contact rachel@beplanetkind.co.uk directly.  First class (£4.50) is estimated at 2-3 days and next day delivery  (£7) are both offered. Collection or delivery locally in Norwich may be possible but please contact me at rachel@beplanetkind.co.uk before ordering to check. If you select this method at checkout but later contact me and it is not possible, Be Planet Kind reserve the right to charge any additional per transaction fees which has been incurred by paying in two portions, so that Be Planet Kind do not suffer this loss.  

  

Please ensure the address details given are correct, as I cannot be held liable if the wrong information is submitted with the order.  


I'll endeavour to get all orders out and to you within 7 posting days, however at busy times this can vary, as can the postal service speed. If there any problems with product availability I will contact you so that you can decide what to do.  

  

Proof of posting is obtained and I'll deal with any claims if your item is not received. Royal Mail may need confirmation from you that delivery has failed. 


Unavailability of items 


Stock is regularly kept up to date and will be checked before confirmation and acceptance of the contract, however if we find that after this point, the item/s are unavailable we will contact you by e-mail or phone (if you have given us details) to discuss how to resolve this. An expected timescale for restock can be given  or you are free to cancel your order.  


Returns and refunds 

Please let me know if you have any feedback or are not satisfied with your order by emailing me at rachel@beplanetkind.co.uk. 


If you change your mind about any items, please return them unopened and unused to us and so we can issue a refund. Once the item has been received, a refund (minus delivery cost) can be made.  Make sure to package the item securely and keep your proof of posting safe until we have confirmed delivery as we can’t refund items which haven’t been safely received. You’ll need to cover the cost of suitable return postage.  Or why not gift it to someone else who might love it?  


If a product is faulty or an incorrect item has been sent, please return within 14 working days, and we will refund this item, including any delivery charges incurred by the buyer for those products affected -excluding 'Special Delivery') in the return of the item. Please note, if you ordered several items, but only return one, we will not refund the original postage, since this will have been incurred anyway.  Please ensure product is packaged adequately and that you retain proof of postage. Please return these to Be Planet Kind, 9 Broom Avenue, Norwich, NR7 0BA. All payments will be refunded by the original payment method and a valid receipt must be proved. 



Cancellation 


If you wish to cancel your order, please get in contact straight away. The earlier this is in the ordering process the more likely it is that we can get the order stopped without incurring postage and other costs. If the item has incurred postage charges these will be deducted from any refund for returned items.  We do not generally refund any items which have been used or opened if sealed unless they are faulty. Please see above.  


Consumers purchasing goods online have a 14-day cooling-off period to cancel their order, after receipt of their order, under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134. Please contact us or request a cancellation form to let us know you are exercising this legal right. If the order is received by you after cancelling the order, please do not unpack these and instead return them immediately to us. Returns should be made to Be Planet Kind, 9 Broom Avenue, Norwich, NR7 0BA and are at the customers cost and risk. Please package and send this securely. Once we have received the goods back in the condition they were sent, we can issue a refund which will be received within 14 days. A portion of this may be deducted if the item is not supplied back in the same condition.

Accuracy of website content 

We work hard to ensure that preparation of content, such as descriptions, images and prices, for the website are quoted correctly and accurately. If, however, a material error is found in the description or price, we may not be able to fulfil and process your order. You will be contacted in this instance, with further details and options.  Be Planet Kind Ltd shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any item. If your expectations are not met, based on the content at www.beplanetkind.co.uk then we will provide you with a refund as per the returns and refunds policy above. 


Legislation 


It is our legal duty to comply with: 

  • The Data Protection Act 2018 which controls how your personal information is used by organisations, businesses or the government. 

  • The Consumer Rights Act 2015- all products must be of satisfactory quality, fit for purpose and as described.  Under the Consumer Rights Act you have a legal right to reject goods that are of unsatisfactory quality, unfit for purpose or not as described, and get a full refund - as long as you do this within the specified time periods. 

  • Trade Descriptions Act 1968 and the Control of Misleading Advertisements Regulations 1988 - All services must be accurately described in promotional materials.
